1. GENERAL CONDITIONS

Company with limited liability BeWooden GmbH, with its registered seat at Bergstraße 81, 61118 Bad Vilbel, Germany, ID: 2022942654, registered in the Commercial Register maintained by the Regional Court in Frankfurt am Main (“Seller“) owns and operates the website www.bewooden.com and www.bewooden.eu (“Website”). These Terms and Conditions (“Terms and Conditions“) governs your relationship with the Seller. Access to and use of this Website and the products and services available through this Website (collectively, the "Services") are subject to the following terms, conditions, and notices (the "Terms of Service"). By using the Services, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.

2. INTELLECTUAL PROPERTY, SOFTWARE, AND CONTENT

The intellectual property rights in all software and content made available to you on or through this Website remains the property of Seller or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by Seller and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.

3. TERMS OF SALE

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Delivery charges will be stated according to your location prior to your order.
In order to contract with Seller, you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Seller retains the right to refuse any request made by you. If your order is accepted we will inform you by emai. All prices advertised are subject to such changes. Please be aware that some of the goods sold through our Websites may not be suitable for children under 18 years of age, so please take extra care when purchasing goods as gifts, for under 18’s.
a. Our Contract
When you place an order, you will receive an acknowledgment e-mail confirming receipt of your order. This email will only be an acknowledgment and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card. 
b. Pricing and Availability
Whilst we try and ensure that all details, descriptions, and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you we will treat the order as canceled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.
The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We, therefore, reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies
c. Payment
Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.
d. Discount Codes
Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website.
The conditions of use relating to any discount code will be specified at the time of issue.

4. SHIPPING & CUSTOMS

Standard shipping within European Union & USA is included in the price. See additional options at payment. Delivery usually takes up to 3-4 days within European Union and up to 10 days within the USA. If you wish to receive your product earlier please contact the Seller prior to your order. 
The seller is not responsible for any kind of delay caused by the shipping company as well as for any additional taxes & customs. If you think you might apply for any additional taxes please inform yourself at local authority – Seller will not cover any of these expenses.

5. WARRANTY

If not state otherwise, all our products are covered with life time warranty. We want to make sure that our customers will enjoy our products for life time. Every complaint will be evaluated separately. The warranty excludes damage caused by behaviour that does not comply with general use of the product. Should a defect occur during the warranty period, the defective product will be repaired by the Seller free of charge or exchanged for a new product. The warranty excludes damage caused by behaviour that does not comply with general use of the product.
All wooden bow ties, cufflinks, wallets, cardholders, business handbags, belts, pocket squares, tie clips, jewellery and mirrors are covered by a lifetime warranty. All other products have a warranty of at least two years.

6. REFUND POLICY

Customer has a right to withdraw from the contract upon 30 days from the day of take-over the standard product. In such case customer does not have to state a reason. When the product is customized (e.g., with a monogram based on customer wish, etc.) the right to withdraw from the contract upon 30 days from the day of take over is no longer applicable. The customer must contact the seller no later than 30 days after delivery of the product by e-mail or mail. Money will be transfered back to the account of the customer within 7 business days.

 7. JURISDICTION

These terms and conditions are to be construed in accordance with the laws of the Germany and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the German courts. Germanlaw shall prevail.

Die BeWooden GmbH ist weder verpflichtet noch bereit, an dem Streitschlichtungsverfahren teilzunehmen.

Zudem ist die BeWooden GmbH weder verpflichtet noch bereit, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
